Is Lying On the Radio...Legal?

Podcast cover

On the Media

The rise of right-wing talk radio, exemplified by Salem Media, has fundamentally reshaped the American political landscape by blending evangelical Christian values with conservative ideology. Salem’s strategy of diversifying across radio, podcasts, and digital news channels allows it to reach vast audiences while promoting narratives like election denial and conspiracy theories. Despite the FCC’s mandate to ensure broadcasters serve the public interest, existing regulations—such as the news distortion policy and the hoax rule—remain effectively unenforceable due to high evidentiary requirements and infrequent license reviews. The 1996 Telecommunications Act further accelerated this trend by enabling massive market consolidation, which prioritized profit over local community needs. Because the electromagnetic spectrum is a public resource, the lack of accountability for disseminating dangerous misinformation highlights a critical failure in the current regulatory framework to protect the democratic process.
