Conversely, restrictive covenants function as contractual obligations that limit land use, such as height restrictions or prohibitions on business activities, and bind future title holders. Architects must verify these legal encumbrances early in the project lifecycle to avoid potential litigation or design failure. While easements can be established through prescription or express grant, they can also be extinguished or prevented through specific legal actions. Understanding these distinctions is essential for ensuring that proposed developments comply with site-specific legal constraints and protecting clients from liability.
